The "Best, Worst and Funniest Pick-Up Line" Contest

OFFICIAL CONTEST RULES AND REGULATIONS

1. NO PURCHASE NECESSARY: The "Best, Worst and Funniest Pick-Up Line" Contest (the "Contest") is sponsored by Palm, Inc., 950 W. Maude Ave., Sunnyvale, CA 94085 (the "Sponsor"). The Contest starts at 9:00:01 AM Pacific Daylight Time ("PDT") on April 5, 2008 and closes at 8:59:59 AM PDT on May 17, 2008 (the "Contest Period").

2. ELIGIBILITY: The "Best, Worst and Funniest Pick-Up Line" Contest is open to legal residents of the fifty (50) United States and the District of Columbia who are twenty-one (21) years of age and older at the time of entry. Employees of the Sponsor, their affiliated companies or agents, their respective advertising or promotional agencies, and the independent judging organization (collectively, the "Promotion Entities") or members of any such employee's immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the employee or not) are ineligible to enter. In these Official Rules, "immediate family" includes mother, father, brothers, sisters, sons, daughters, partner or spouse.

3. PROMOTION DESCRIPTION: The Contest consists of three (3) ways to win prizes. Eligible persons will receive one (1) entry into the Grand Prize drawing upon registration as a Contest Member, as defined and more fully set forth below. Secondary prizes will be awarded to the top vote getting pick-up line in each of the three (3) categories, as more fully set forth below . Finally, Contest Members will automatically receive one (1) entry into the daily prize drawings for logging in as a Contest Member and one (1) additional entry for each time they ; vote on a Contest submission; or provide a comment to a Contest submission (max. of 5 entries each method per day), as defined and more fully set forth below.

4. HOW TO REGISTER AS A CONTEST MEMBER: Visit www.PalmPickUp.com (the "Website") to create your "Best, Worst and Funniest Pick-Up Line" profile ("Profile"). Enter a valid and unique email address, a password (6 characters or more) and confirm the password by entering it again. Complete the Profile including full name, complete mailing address (including zip code), daytime telephone number (including area code), confirm that you have read the rules and regulations and click the "submit" icon at the bottom of the screen. Upon doing so, your registration will be complete and you will become a member of the "Best, Worst and Funniest Pick-Up Line" Contest (a "Contest Member") and receive one (1) entry into the Grand Prize drawing. Limit one (1) Grand Prize entry per person/email address for the entire Contest. You may not register as a Contest Member more than once.

5. HOW TO GET ENTRIESS INTO THE DAILY DRAWINGS: Upon completing registration on the Website, Contest Members will receive one (1) entry into the daily prize drawing each day they log in during the Contest Period (max. 1 entry per person/email address per day); enter a pick up line or vote on a pick-up line submission (max. 5 entries per person/email address per day); or submit an approved comment on a pick-up line submission (max. 5 entries per person/email address per day). An alternate form of entry is through m.palmpickup.com ("Mobile Website"). Contest Members will receive one (1) entry into the daily prize drawing each day they log into the Mobile Website (max. 1 entry per person/email address per day) or submit an approved comment on a pick-up line submission (max. 5 entries per person/email address per day) during the Contest Period. Limit of (11) daily drawing entries per Contest Member per day (either Website or Mobile Website). Carrier specific charges for mobile internet access may apply, depending on your individual cellular pricing plan, in accordance with your cellular customer agreement. Mobile internet may not be available for all service providers or for all mobile devices. Cellular phone carrier's instructions for mobile internet may be different. Check your mobile device's capabilities for specific instructions. The mobile internet entry portion of this Contest works with most U.S. cellular carriers and requires a mobile internet enabled cellular device. Check with your service provider for details. When participating in the Contest via the mobile internet method of entry, the entrant grants permission to the Sponsor to notify them via their mobile device and must agree to accept all applicable charges associated therewith. Mobile internet participants are responsible for all applicable fees and taxes associated with placing a mobile internet entry.

6. HOW TO SUBMIT A "BEST, WORST OR FUNNIEST" PICK-UP LINE:
To submit a pick-up line, log-in to your Contest Member account and follow the online instructions to submit your pick-up line (the "Submission"). Each Submission that is entered into the Contest must meet the following "Submission Requirements" (any Submission that in Sponsor's sole and absolute discretion violates the following criteria will be disqualified):
- the Submission must be between 10 and 500 characters in length and written primarily in English;
- A maximum of 40 approved pick-up line submission entries per person/email address received through either the Website or Mobile Site;
- the Submission must be the Contest Member's original, previously unpublished pick-up line and not infringe upon the rights of any third party;

Submissions must be received by the end of the Contest Period. Any Submission that is considered by Sponsor in its sole and absolute discretion to be obscene, pornographic, libelous, hate speech or otherwise objectionable, in whole or in part, will be disqualified and will not be eligible for entry. All requested information on the Website must be completed to enter and to be eligible to win. Any communication or information transmitted to Sponsor and/or the Website by electronic mail or otherwise is and will be treated as non-confidential and nonproprietary. Proof of submission is not considered proof of delivery to or receipt of such entry. Furthermore, Sponsor shall have no liability for any Submission that is lost, intercepted or not received by the Sponsor.

7. VOTING AND SECONDARY PRIZE WINNER SELECTION: To vote for a pick-up line, log-in to your Profile and click on the "Pick-Up Line Gallery" icon to view submitted Pick-Up Lines and rate each Submission based on a scale of -5 to +5. Each Contest Member may rate each Pick-Up Line one time. Automated methods of voting are prohibited. As part of the voting process, voters will also select the category that they feel the submission best represents (best, worst or funniest). Submissions may receive votes in any and/or all three categories. Contest Members may vote on a pick-up line until May 20, 2008 at 11:59:59 PM PDT at which time the Submission in each Category receiving the highest average score will be a Secondary Prize winner, subject to verification. In the event of a tie, the Sponsor will determine the winner in its sole discretion. Voting for the Secondary Prize Winners ends May 20, 2008 at 11:59:59 PM PDT.

8. RANDOM DRAWINGS
i. GRAND PRIZE DRAW: The Grand Prize Draw will take place on or about May 23, 2008 from among all the Grand Prize drawing eligible entries received by the end of the Contest Period. The odds of being selected for the Grand Prize depend on the number of eligible entries for the Contest Period.
ii. DAILY PRIZE DRAWS:
Each day commencing April 06, 2008 and ending May 17, 2008 a drawing will take place from all eligible entries received between 9:00:00 AM (PDT) and 8:59:59 AM (PDT) the next day ("Daily Drawing Period"). For example, the Daily Draw for the April 5, 2008 Daily Draw Prize Period will take place the following day on April 6, 2008 from all eligible entries received between 9:00:00 AM (PDT) on April 5, 2008 and 8:59:59 AM (PDT) on April 6, 2008. Each Daily Prize draw will be conducted by the independent judging organization from among all eligible entries received during the relevant Daily Drawing Period. The odds of winning a Daily Prize depend on the total number of eligible entries received for the Daily Drawing Period. If for any reason there are no entries for a particular Daily Drawing Period, the Daily Prize for that day will not be awarded. Non-winning entries in the Daily Draw will not be carried forward into subsequent drawings.

9. CONTACTING GRAND, SECONDARY AND DAILY PRIZE WINNERS: The potential winners will be notified by telephone and/or mail and/or email using the contact information provided at the time of registration. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If, despite reasonable efforts, a potential winner does not respond within three (3) days of the first notification attempt (or such shorter time as exigencies may require), or if the prize or prize notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected. If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified and an alternate winner may be selected. Sponsor will successively attempt to contact up to two (2) potential winners of the prize in accordance with such procedure, and if there is still no confirmed winner of the prize in question after such attempts have been made, the prize may go unawarded.

10. PRIZES:
i. Grand Prize. There will be one (1) Grand Prize available, consisting of a trip for up to six (6) adults (the winner and up to five (5) guests) to Las Vegas Nevada, including round-trip economy airfare for six (6) adults departing from the major airport nearest the winner's residence; four (4) nights double-occupancy luxury hotel accommodation at a hotel as selected by the Sponsor on the Las Vegas Strip; limo transportation to and from the airport to the hotel and a VIP Happy Hour Experience. The approximate retail value of the Grand Prize Package is $18,000.00 US. The winner and his/her travel guests must each have valid travel documents prior to ticketing, be legally able to travel within the USA and be twenty-one (21) years of age or older. The winner and his/her travel guests must travel on the same itinerary. The trip must be taken by December 31, 2008 or the Grand Prize Package will be forfeited. All departure taxes (at the time of booking), transfers, insurance, items of personal nature and all other costs and expenses not specifically stated as included herein are the sole responsibility of the winner and his/her travel guests. Reservations will be accepted based on space availability, and must be booked a minimum of thirty (30) days prior to the departure date. Blackout periods may apply. No frequent flyer miles will be available for this trip. In the event that the winner does not use any portion of the Grand Prize Package, there will be no extension, transfer, substitution or any kind of compensation provided. The Grand Prize Package must be accepted as awarded without substitution and is not transferable, not for resale and has no cash surrender value. The Sponsor reserves the right, in the event that the Grand Prize Package or any component of the Grand Prize Package cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. Average Retail Value (ARV) for travel prizes may vary depending upon points of departure and destination and fare fluctuations. If the closest airport to a prize winner's home is in close enough proximity to prize destination city so that, as Sponsor may determine in its sole discretion, a flight is unnecessary, such prize winner will receive alternate transportation from the Sponsor with no further obligation to the winner. Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the Grand Prize ARV in these Official Rules. Sponsor reserves the right to structure the travel route and select hotels in its sole discretion. In the event Grand Prize winner and/or his/her travel companion(s) engages in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send Grand Prize winner and/or his or her travel companion(s) home with no further compensation.
ii. Secondary Prize. There are three (3) Secondary Prizes available to be won, each consisting of a Caribbean Cruise Getaway for two (2) adults (winner and one (1) guest) as selected by the Sponsor, including round-trip economy airfare for two (2) adults departing from the major airport nearest the winner's residence to Fort Lauderdale, FL or Miami, FL (to be determined at Sponsor's sole discretion); four (4) night Grand Suite accommodation based on double occupancy and one Cocktail Catamaran excursion. Approximate retail value of each secondary prize is $5,000.00 US. Secondary Prizes must be accepted as awarded. The winner and his/her travel guests must each have valid travel documents prior to ticketing, be legally able to travel to the Caribbean and be twenty-one (21) years of age or older. The winner and his/her travel guest must travel on the same itinerary. The trip must be taken by December 31, 2008 or the Prize Package will be forfeited. All departure taxes (at the time of booking), transfers, insurance, items of personal nature and all other costs and expenses not specifically stated as included herein are the sole responsibility of the winner and his/her travel guest. Secondary Prize winners will not receive cash or any other form of compensation if actual travel costs are less than the Secondary Prize ARV in these Official Rules. In the event Secondary Prize winner and/or his/her travel companion engages in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send Secondary Prize winner and/or his or her travel companion home with no further compensation.
iii. Daily Prizes. There will be one (1) Daily prize available to be won each day during the Contest Period. Each Daily Prize will consist of a PalmĀ® Centro Smartphone for AT&T. Approximate retail value of each Daily Prize is $349.99 US. Daily Prizes must be accepted as awarded. Daily Prizes may not be sold, transferred and are not convertible to cash. The Contest Sponsor reserves the right to substitute a Daily Prize in whole or in part in the event that all or any component of a Daily Prize is unavailable. The ARV of any electronic prize is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. If the actual purchase price of an electronic prize is less than the ARV stated herein, the prize winner will NOT be entitled to a check, cash or other form of payment for the price difference.

Total approximate retail value of all prizes: $50,600.00.

11. GENERAL PRIZE CONDITIONS: Limit one (1) Grand Prize, one (1) Secondary Prize and one (1) Daily Prize per Contest Member. To be declared a Grand or Secondary Prize winner, each selected entrant will be required to complete, sign and have notarized, an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release ("Affidavit/Release") confirming compliance with the Official Rules, acceptance of the Prize as awarded, without substitution, and releasing the Promotion Entities and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (collectively, the "Released Parties") from any liability in connection with the Prize or this Contest. The Affidavit/Release must be returned within the time period specified on the Affidavit/Release along with any other documentation that Sponsor may require, or the selected entrant may be disqualified and another Contest Member may be declared the winner at Sponsor's sole discretion. The Winner may be required, upon the Sponsor's request, to complete additional documentation that, among other things, grants the Sponsor the right to distribute and/or to exploit the winner's Submission for whatever purpose the Sponsor chooses without further compensation. Traveling Guests (Grand Prize package and Secondary Prize package) will also be required to sign a Liability/Publicity Release releasing the Released Parties prior to ticketing.

12. GENERAL: By entering the Contest entrants agree to abide by the Official Rules and the decisions of the independent contest organization with respect to all aspects of the Contest, which are final.

13. Prize Winners will be solely responsible for all federal, state and local taxes or licenses on prizes.

14. The Sponsor accepts no responsibility for loss, damage or claims caused by or resulting from the Contest or the Prizing. By entering and/or accepting a Prize, the Prize Winners consent to the use of his/her name, address (city and state) and/or photograph without further compensation, in connection with any publicity carried out by or on behalf of the Sponsor with respect to this Contest, except where such requirement is prohibited.

15. The Sponsor and the independent judging organization will not be responsible for late, lost, illegible, incomplete or destroyed entries and all such entries are void. The Sponsor and the independent judging organization do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer lines or networks, computer equipment, software or any combination thereof. Entry material/data that have been tampered with or altered are void. In the event it is determined that an entrant has entered in a fashion not sanctioned by these rules and/or has submitted more than the number of entries permitted by these rules, the entrant will be disqualified and all of the entries submitted by the entrant will be disqualified. The use of an invalid email address will disqualify the entry. Users spamming the same email address will disqualify the entry. Users using an automated script or program to send to a friend will be disqualified.

16. All entries become the permanent property of the Sponsor and none will be returned. No correspondence will be entered into except with the selected entrant. This Contest is subject to all applicable federal, state and local laws.

17. WINNER'S LIST: For names of winners, send a self-addressed, stamped envelope by 8/30/08 to: The Best, Worst and Funniest Pick-Up Line Contest, Palm, Inc., 950 W. Maude Ave., Sunnyvale, CA 94085. Winner's list to be available after 6/30/08.

The Sponsor respects your right to privacy. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Sponsor.
